英国鉄道の技術的コントロールと規制緩和時代における技術行政の役割

概要	交通事業においては，環境保全，安全性確保，消費者保護など，種々の視点に立った技術的コントロールが必要である．しかし，これらも現代の規制緩和時代には，民間事業者の創意と活発な経営を促すよう，効率的で効果的な方式によって進めることが不可欠である．現在，わが国の鉄道でも新たな技術的コントロールの体系の創設が検討されていることを踏まえ，本稿では，英国の鉄道を対象として，Safety Caseの制度や自己責任制を基礎とした技術基準など，特色にあふれた技術的コントロール制度を調査分析した．さらに，その底流にある英米型の経験主義哲学的なものの考え方と，規制緩和時代における技術的コントロールのあり方を考察した．

Title	Technical Control Systems upon Railways in UK and the Role of Governments under the Deregulation Context

Abstract	Measures of technical control by public sectors are essentially required upon transport industries from various viewpoints, such as environmental protection, securing safety, and consumer protection. However, these measures must be efficient and effective enough so that they would not hamper vigorous and creative activities of private firms. This paper systematically deals with the current technical control system in railways in UK which was completely revised after the drastic organizational restructuring held in 1994, and discusses the basic way of thinking laying under their institutional system. The author also suggests the desirable direction of improvement in Japanese system of technical control in railways.
